Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Temblee.

By creating an account, unlocking a template, opening a shop, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.

If you are using the Service on behalf of a business or other organization, you represent that you have authority to bind that organization, and "you" refers to both you and that organization.

2. Eligibility

The Service has two age floors, depending on what you use it for.

Buyers. To create an account and browse or unlock Templates, you must be at least 13 years old, or the minimum age required to lawfully use an online service in your country of residence, whichever is higher. By registering, you represent and warrant that you meet this requirement.

Shop Owners. To open a shop, you must be at least 18 years old. Operating a shop means entering into a binding commercial relationship with Temblee, warranting that you own or are licensed to sell your Templates, agreeing to indemnify us, and accepting the licensing terms in Sections 5, 7, and 16, so we require you to explicitly confirm your age as part of the shop application, in addition to this eligibility requirement (see Section 5.1).

You may not use the Service if you are barred from doing so under the laws of your country of residence or if you appear on any applicable sanctions or restricted-party list.

Where the Service is available. Browsing and unlocking free Templates are open to everyone who may lawfully use the Service. Paid features are not. When we introduce them (Sections 5.3 and 6.3), they will be available only to Buyers in the countries we list at that time, and only Shop Owners who can hold an account with our payment processor in a supported country will be able to offer them. We may add or remove countries, and may withdraw paid features in a country, for legal, tax, or payment-processing reasons. None of this affects free Templates, or any Template you have already unlocked.

3. What Temblee is and is not

Temblee is a marketplace. Independent shop owners ("Shop Owners") list design templates ("Templates") that registered users ("Buyers") can browse and unlock.

Unlocking a Template gives you a link that opens the design in the third-party tool it was created with (for example Canva, Figma etc..). Temblee does not host, store, or deliver the design file itself. Access to the Template depends on the third-party tool, the Shop Owner's account with that tool, and that tool's own terms.

Temblee is not a party to the agreement between a Buyer and a Shop Owner regarding a Template, except where these Terms expressly say otherwise. We do not act as the agent of any Buyer or Shop Owner. We do not create, endorse, or independently verify the Templates listed on the Service.

We review new shop applications and inspiration posts before they go live. This review is limited and does not mean we have verified ownership, quality, accuracy, legality, or fitness for any purpose. Approval by Temblee is not an endorsement or a warranty.

Buyers may report a Template for issues like a broken link or a listing that doesn't match its preview. We review these reports and may act on them, including editing, unpublishing, or removing the Template (see Sections 5.2 and 17.1).

4. Accounts

4.1 Creating an account

You need an account to unlock Templates, post inspiration photos, comment, or apply to open a shop. You can register with an email address and a one-time code we send to that address, with an email address and password, or by signing in through Google or Facebook. If you use a third-party sign-in, you authorize us to receive the account information that provider shares with us, as described in our Privacy Policy. Setting a password is optional, an account created with an email code can keep using codes, or add a password later in account settings.

You agree to provide accurate, current, and complete information and to keep it up to date.

4.2 Account security

You are responsible for keeping your credentials confidential and for all activity that occurs under your account, whether or not you authorized it. Notify us immediately at security@temblee.com if you suspect unauthorized access. We are not liable for losses arising from your failure to safeguard your credentials.

If you sign in with emailed one-time codes, your email account is your credential: anyone who can read your inbox can sign in as you. Keep that email account secure, and protect it with its own strong password and two-factor authentication where available.

4.3 One account per person

You may not maintain more than one account without our written permission, share your account, or create an account on behalf of someone else without their authorization.

4.4 Suspension and termination by us

We may suspend, limit, or terminate your account or any part of the Service, with or without notice, if we reasonably believe you have:

  • breached these Terms or any policy incorporated into them.
  • uploaded or listed content you do not have the rights to.
  • abused the comment, review, reporting, or moderation systems.
  • engaged in fraudulent, deceptive, or unlawful activity, including payment fraud or chargeback abuse.
  • created risk or possible legal exposure for us, other users, or third parties or been inactive for an extended period.

Where practical and lawful, we will give you notice and an opportunity to respond. For serious or repeated violations, suspension may be immediate and permanent.

If we suspend a shop, we will tell the Shop Owner by email and include the reason, unless the law or safety concerns prevent it. While a shop is suspended, its Templates are not listed and cannot be newly unlocked, but Buyers who already unlocked them keep access.

5. Shops and Shop Owners

5.1 Applying to open a shop

Shops are open to everyone. Any registered user with a verified email address who is 18 or older may request to open a shop, and no invitation is needed.

Opening a shop requires an application, an explicit confirmation that you are 18 or older (Section 2), and our approval. We may approve or decline any application at our discretion, and may require identity or business verification before a shop goes live.

5.2 Shop Owner responsibilities

If you operate a shop, you represent, warrant, and agree, for each Template you list, that:

  • You own it or are licensed to sell it. You own all rights in the Template, or hold all licenses and permissions necessary to offer it on the Service, including rights to any fonts, photographs, illustrations, icons, or other assets it contains, and including the right to sublicense those elements to Buyers on the terms in Section 7.
  • Your previews are accurate. Preview images and descriptions truthfully represent what a Buyer receives after unlocking.
  • Your listing details are correct. Category, description, the design tool the Template opens in, and any stated usage limits are accurate and kept current.
  • The unlock link works. You will maintain a functioning link in the applicable third-party tool for as long as the Template remains listed, and for at least 30 days after you delist it or close your shop, so existing Buyers retain the access they already unlocked.
  • It is lawful. The Template does not infringe any third party's intellectual property, privacy, publicity, or other rights, and does not violate any law or the terms of the third-party tool it was built in.

You are solely responsible for your Templates and for any claims arising from them.

5.3 Free listings and fees

Shop Owners can currently list Templates only as free Templates. The Service does not offer a way to set a price on a Template, Temblee does not currently process payments, and there is no fee to list a Template or operate a shop.

Because every listing is free, you may not charge, or ask Buyers to pay, for access to a Template you list on the Service, including by placing the linked design behind a paywall, a paid subscription of your own, or a request for payment after unlock. Templates that do this may be unpublished or removed (Section 4.4).

We intend to introduce premium Templates and paid unlocks in the future. If we do, we will publish a fee schedule and updated payout terms and give Shop Owners at least 30 days' notice before any fee takes effect. No commission or fee will be charged on unlocks that occurred before then. You will not be required to sell Templates for payment, once premium listings are available, pricing a Template will always be your choice.

If you receive payment from a Buyer outside the Service for anything other than access to a Template you list here (for example, custom design work), that transaction is entirely between you and the Buyer. Temblee is not a party to it, does not process it, and accepts no responsibility for it. You are solely responsible for determining, collecting, and remitting any taxes you owe on it.

5.4 Pausing a shop

You may pause and resume your shop at any time from your shop settings. While your shop is paused, your Templates are not listed on the Service and cannot be newly unlocked, and your shop page tells visitors you are taking a break.

Buyers who already unlocked your Templates keep access while you are paused, so your obligations in Section 5.2, including keeping unlock links working, still apply. Pausing does not limit our ability to suspend a shop under Section 4.4.

5.5 Closing a shop

You may close your shop from your shop settings. Closing is permanent. Your Templates are removed from the marketplace immediately, and your shop name and shop address are released for others to use. Where a Buyer still has access to one of your Templates, your shop is shown to them only as a "Closed shop".

Closing does not revoke access already granted to Buyers who unlocked your Templates, and does not entitle you to reverse completed transactions. As part of closing, you confirm that you will keep your unlock links working for at least 30 days (Section 5.2), and we let those Buyers know so they can save their own copies. After that 30-day period, Temblee cannot guarantee that links to a closed shop's Templates keep working.

Templates that nobody has unlocked or posted about are deleted when you close. You may apply for a new shop later, subject to approval under Section 5.1, it starts without your previous shop's Templates.

6. Unlocking Templates

6.1 Templates are currently free

All Templates on the Service are currently free to unlock. Temblee does not process payments and does not collect payment card or bank details from anyone. If any page, listing, or communication asks you to enter payment details for a Temblee unlock, it is not from us, please report it to support@temblee.com.

6.2 What an unlock is

An unlock is a license to access a Template on the terms in Section 7, not a sale of the design or of any file. Unlocks are tied to your account and are not transferable, resellable, or assignable.

Unlocking a Template does not guarantee permanent access. Access depends on the Shop Owner maintaining a working link in the third-party tool (Section 5.2), including after a shop closes (Section 5.5), and on that tool remaining available (Section 12). Because unlocks are free, Temblee provides them as a courtesy and without charge, and does not guarantee that any particular Template will remain accessible.

6.3 Paid unlocks in the future

We may introduce paid unlocks. If we do:

  • we will give at least 30 days' notice under Section 18 before paid unlocks become available, and publish separate purchase, refund, and payment terms at that time.
  • Templates you have already unlocked for free will remain unlocked at no charge, and we will not retroactively charge for them.
  • prices will always be shown clearly before you unlock anything, and no charge will ever be made without your express authorization at the point of purchase and
  • payments will be handled by a third-party payment processor, and your rights under consumer law including the EU and UK rights of withdrawal for digital content will be set out in those terms and
  • paid features will be offered only in the countries listed at that time (Section 2), while free Templates stay available everywhere the Service is.

Until that happens, nothing in these Terms obliges you to pay Temblee anything.

7. License granted by an unlock

Unless a Shop Owner's listing states broader or narrower terms, unlocking a Template grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • open and edit the Template in the applicable third-party tool, for your own personal or business use and publish, print, or distribute the finished designs you create from it.

You may not:

  • resell, redistribute, sublicense, or give away the Template itself, whether modified or unmodified.
  • list the Template, or a remix of it that is not substantially transformed, on Temblee or any other marketplace.
  • share your unlock link or account access with others or use the Template in a way that violates the terms of the third-party tool it lives in, or the license terms of any font, image, or asset it contains.

Fonts, stock photographs, and similar third-party assets inside a Template may carry their own licenses that limit how you can use them. Where a Shop Owner discloses such limits, they apply to you.

This license ends if your account is terminated for breach of these Terms.

8. User content

8.1 Your content

"User Content" means anything you submit to the Service, including inspiration photos, comments, shop descriptions, profile information, and Templates. You retain ownership of your User Content.

8.2 License you grant us

You grant Temblee a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt (for formatting and display), publish, and display your User Content for the purpose of operating, promoting, and improving the Service. This license lasts while your content is on the Service and for a reasonable period afterwards to allow for backups and cached copies.

You represent that you have all rights necessary to grant this license, and that your User Content does not infringe anyone's rights.

8.3 Rules for User Content

Do not post content that:

  • infringes intellectual property, privacy, or publicity rights,
  • is abusive, harassing, hateful, threatening, or discriminatory,
  • is sexually explicit, or depicts or endangers minors,
  • is spam, deceptive, or commercially unrelated to the Template it is attached to,
  • contains malware or links to harmful sites,
  • discloses another person's private information without consent or violates any applicable law.

Inspiration posts are reviewed before public display and may be rejected. We may remove, edit, or refuse any User Content at any time, with or without notice, but we have no obligation to monitor content and are not responsible for User Content posted by others.

9. Acceptable use

You agree not to:

  • scrape, crawl, or harvest data from the Service, circumvent unlock or access controls, or attempt to obtain Templates other than through the unlock feature.
  • reverse engineer, interfere with, or place unreasonable load on the Service
  • use bots or automated means to create accounts, post content, or manipulate rankings, reviews, or comments, impersonate any person or entity, or misrepresent your affiliation
  • solicit users to transact outside the Service in a way that circumvents these Terms or use the Service to develop a competing product or to train machine learning models on Templates or User Content without permission.

10. Intellectual property in the Service

The Service itself including the Temblee name, logo, interface, code, and design is owned by Temblee and protected by intellectual property laws. These Terms grant you no rights in it beyond the limited right to use the Service as intended. You may not use our trademarks without our prior written permission.

Feedback you send us is voluntary, and we may use it without obligation or compensation to you.

11. Copyright complaints

We respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA) and comparable laws. If you believe content on the Service infringes your copyright, send an email to legal@temblee.com:

Your email must include: your physical or electronic signature, identification of the work claimed to be infringed, identification of the material you claim is infringing and its location on the Service, your contact information, a statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf.

Counter-notices may be submitted to the same email address. We terminate the accounts of repeat infringers. Knowingly making a material misrepresentation in a notice or counter-notice may make you liable for damages.

12. Third-party tools and links

Templates are opened and edited in third-party tools such as Canva, Figma etc. Those tools are operated by companies independent of Temblee, under their own terms and privacy policies. We do not control them and are not responsible for their availability, pricing, account requirements, or the loss of access to any design held within them. You may need your own account with a third-party tool, and possibly a paid subscription to that tool, to use a Template.

The Service may link to other third-party sites. We are not responsible for their content or practices.

13. Account deletion

You may delete your account at any time from your account settings.

Shop Owners must close their shop before deleting an account. You can do this from your shop settings (Section 5.5). Once your shop is closed, you may delete your account. Templates from your closed shop stay available to Buyers who already unlocked them, but are no longer linked to your account.

Deleting your account removes your profile and stops future access to Templates you unlocked. Some information is retained after deletion where we have a legal obligation or a legitimate need to keep it for example, records relating to fraud, abuse, copyright complaints, or safety, and, once paid unlocks exist, transaction records required for tax and accounting purposes. See our Privacy Policy for details, and for the rights you may have to access or erase your personal data.

Sections that by their nature should survive termination including Sections 7 (as to breach), 8.2, 10, 14, 15, 16, 17, and 18 survive.

14. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Temblee disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free that Templates will meet your expectations, be free of third-party claims, or remain accessible in the third-party tools that host them or that any Shop Owner will perform its obligations to you.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or for consumers' non-excludable statutory rights.

15. Limitation of liability

To the fullest extent permitted by law:

  • Temblee will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, however caused and under any theory of liability, even if advised of the possibility.
  • Temblee's total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the total amount you paid to Temblee in the 12 months before the event giving rise to the claim, or (b) USD 100.

These limits apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify, defend, and hold harmless Temblee and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: your use of the Service, your User Content or Templates, your breach of these Terms, or your violation of any law or third-party right.

We may assume exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate.

17. Disputes

17.1 Between users

Disputes between a Buyer and a Shop Owner are primarily between those parties. You may contact support@temblee.com and we may, at our discretion, help mediate, remove a listing, or reverse an unlock, but we are not obliged to and are not a party to the underlying dispute.

17.2 With Temblee

Before filing a claim, you agree to try to resolve it informally by contacting legal@temblee.com. If it is not resolved within 30 days, either party may proceed.

17.3 Governing law and venue

If you are a consumer resident in the EU, UK, or another jurisdiction with mandatory consumer protections, nothing here deprives you of the protection of the mandatory laws of your country of residence, or of the right to bring proceedings in your local courts.

18. Changes to these Terms

We may update these Terms as the Service changes. For material changes, we will give at least 30 days' notice by posting the updated Terms with a new "Last updated" date and, where we have your email address, by emailing you.

Changes take effect on the stated effective date. If you continue to use the Service after that date, you accept the revised Terms. If you do not agree, stop using the Service and delete your account before the effective date, changes will not apply retroactively to unlocks completed before then.

19. General

  • Entire agreement. These Terms, together with the Privacy Policy and any policies referenced in them, are the entire agreement between you and Temblee about the Service.
  • Severability. If a provision is held unenforceable, the rest remains in effect and the unenforceable provision is modified to the minimum extent necessary.
  • No waiver. Our failure to enforce a right is not a waiver of it.
  • Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
  • No agency. Nothing here creates a partnership, joint venture, employment, or agency relationship between you and Temblee.
  • Notices. We may send notices to the email address on your account. You may send notices to legal@temblee.com.
  • Language. These Terms are drafted in English, any translation is provided for convenience and the English version controls.
